By using this website you agree to these terms. If you become a client, your signed client agreement sets out the full terms of our work together, and it takes priority over this page.

Using this website

You may use this website to find out about our services and to contact us. Please don't misuse it, try to break its security or copy large parts of it for commercial use. The content is general information, not professional advice for your business. We work to keep it accurate and up to date, but we can't promise it always will be.

The concept designs shown on this site were created by HigherDev for our portfolio. They are not client work, and no results are claimed for them.

Book a Consultation and Complimentary Website Review

Booking a consultation is free and carries no obligation. Before the call, a person on our team reviews your public website and prepares findings to talk through. The review and any mockup, audit or proposal we show you stay ours. Please don't use them, or pass them to anyone else, unless you go on to sign with us.

Services, scope and quotes

Every project is agreed in writing before work starts. Your order form and client agreement describe what's included in your package. Anything not listed, such as extra pages, new features, paid advertising, photography or ecommerce, is quoted separately and only starts once you agree the quote in writing.

Each build includes two rounds of changes at the design stage and one round at the build stage. Timescales are estimates and depend on us receiving your content and feedback on time.

Fees, care plans and cancellation

All prices exclude VAT. HigherDev is not currently VAT registered. If that changes, VAT will be added at the rate in force.

• Deposit: 50% of the build price when you sign, before we start work.
• Balance: the remaining 50% when we tell you the site is ready, before it goes live.
• Care plans: billed monthly from launch, with a 12-month minimum term. After that they run month to month and either of us can end them with 30 days' written notice.
• Cancelling before launch: if we haven't started work, we refund your deposit. Once work has started, the deposit is non-refundable.

Spread payment options are only offered once they're set out in your client agreement.

Ownership of work

You always own your business name, branding, the content you give us, your domain name and the enquiries your site collects. Once the build price is paid in full, we transfer to you the copyright in the bespoke design and site content we created for you. We keep the rights in our own tools, templates and code, and you have a licence to use them as built into your site.

We will only show your website, name or logo in our portfolio or marketing with your written permission.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. We are not liable for loss of profit, business, revenue or goodwill, or for indirect or consequential loss. For clients, our total liability is limited to the fees paid to us in the 12 months before the claim arose. We are not responsible for problems caused by events outside our reasonable control, including outages at third-party platforms.

If you're unhappy with anything, email [email protected]. We'll acknowledge it, look into it properly and reply as quickly as we can.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and nothing in these terms affects your statutory rights as a consumer.

Changes

We may update these terms from time to time. The date at the top shows when they last changed.
